Terms of service

Draft of 12 September 2026 · hypersmashstudios.com, Mini Wars, and the Founder's Pass
Draft under review. These terms describe how the site and game work today. They have not yet had a professional read, the studio's legal entity will be named when it is settled, and the refund section is a proposal awaiting the partners' decision. Until this notice is gone, treat them as our working statement.

These are the terms between you and Hypersmash Studios ("we", "us") for using this site, holding an account, playing Mini Wars, and — when it goes on sale — buying the Founder's Pass. By creating an account you accept them. They are short on purpose; if a sentence is unclear, ask us and we will fix the sentence.

1. Who can have an account

You must be 13 or older to create a Hypersmash account. Sign-up asks your birth month and year first, and refuses under-13 answers without keeping them. If you are under 18, we assume a parent or guardian is fine with you playing and, if the pass is on sale, with any purchase made on your account. One person, one account; accounts may not be sold or handed over.

2. Names are permanent

Your username, display name and commander name are chosen once and are permanent by design: they are how other players know you on the ladder, at the table and in the credits. Choose something you are happy to keep. Names that impersonate someone, contain slurs or abuse, or are designed to confuse may be changed or removed by us, and the account may be suspended (section 6).

3. Mini Wars

Mini Wars is in active development. Versions change, sometimes weekly; features, balance, maps and saved progress may be altered or reset between versions, and we will say so in the patch notes when that happens. Access to the game itself is for Founder's Pass holders and for players we have given a playtest code; a free account alone lets you hold a name, use the account page and take part in the message wall.

4. The Founder's Pass

Not on sale yet. This section applies from the day it is. The Founder's Pass is a one-time purchase, not a subscription. It grants:

The pass is sold only until our second game ships; after that it is retired and not sold again. The price shown at checkout is the price you pay. Payments are processed by Stripe; we never see your card details. Whether the displayed price includes VAT or sales tax depends on where you are and will be shown before you pay.

5. Refunds

Proposed text — the partners have not yet decided the refund window (agenda item; see hypersmash-web #11). Replace or confirm before publication.

Because the pass is digital content that starts working the moment it is bought, you agree that access begins immediately and that the usual 14-day withdrawal right for distance purchases in the EU and UK is waived once you first open the game with the pass. If you buy the pass and do not open the game, or if the game is unavailable to you for a technical reason we cannot fix, ask us within 14 days and we will refund the purchase in full. Refunds go back to the original payment method.

6. Playing fair

In multiplayer and on the ladder you agree not to cheat (modified clients, automation, exploiting bugs to win), not to harass other players, and not to post anything on the message wall that is abusive, illegal or spam. We may remove content, reset ratings, suspend or close an account that breaks these rules; we will tell you why, and you can reply through the contact page. Suspension does not refund a pass except where section 5 already applies.

7. Your account and your data

Keep your password to yourself; you are responsible for what is done from your account. Verify a recovery email or keep recovery codes — those, or a linked provider, are the only ways back in, and by design we cannot restore an account that has none of them. What we collect and why is in the privacy policy. You can delete your account yourself from the account page; deletion is permanent and also ends any pass on it.

8. Ownership

Mini Wars, its art, sound, code, names and the Hypersmash Studios name are ours or licensed to us. The pass gives you a personal, non-transferable right to play, not ownership of the game or any part of it. Messages you post on the wall are yours; you give us the right to show them, for the 25 seconds they exist. We are happy for you to stream, record and share the game.

9. A game still being made

The site and the game are provided as they are. We work hard on them, but we do not promise they will be free of bugs, available at all times, or the same tomorrow. To the extent the law allows, our liability to you for anything arising from the site or the game is limited to the amount you paid us in the twelve months before the claim; nothing in these terms limits liability that cannot be limited by law, or your statutory rights as a consumer.

10. Changes and governing law

We may update these terms as the studio and the game grow; the date at the top is the current version, and material changes will be announced on the site before they take effect. These terms are governed by the law of the place where the studio is established, without taking away consumer protections you have where you live.

11. Contact

Use the contact page. It reaches the two of us who build the game.
